Beyond Homes Virtual Resident Services Program Terms & Conditions
Scope of Authorization
This consent form covers all forms of virtual resident services and web-based applications, including but not limited to, video conferences via Zoom, use of social networks, virtual clubs, and one-on-one virtual engagement sessions. Participant images may be transmitted during video portions of virtual services. This applies to both adult and minor participants who are working from home on their own computer or using a computer in Abode Communities' computer lab.
Given the proposed virtual services are web-based, content accessed from the home or elsewhere outside the property could put participants in contact with objectionable materials via the Internet.
Parents: It is the responsibility of the parent/guardian of the student to restrict any access to materials deemed inappropriate by the parent/guardian.
Privacy
Abode Communities is proud to provide its virtual Beyond Homes' resident services program to adults and children (herein referred to as "Program"). The organization acknowledges that some program participants may be under the age of 18, and that some users may be under the age of 13 (collectively, "Minor/Minors".) Abode Communities is committed to protecting online privacy of all participants, including Minors, and meeting the requirements of the California Online Privacy Protection Act of 2003 (OPPA) and the federal Children's Online Privacy Protection Act of 1998 (COPPA). Therefore, Abode Communities has provided this Privacy Policy, which describes how the organization collects, uses, and discloses personal information provided by participants, including Minors, at gobeyondhomes.org.
How do we collect and use information?
Anyone who participates in the Program will be required register and to provide certain limited personal information in order to participate. During the registration process, Abode Communities actively collects information from participants. Abode Communities will collect name, property name, address, phone numbers, emergency contact information, email, and login credentials.
In addition, Minors must be enrolled separately to participate in youth programming. Abode Communities collects the Minor's name, age, date of birth, ethnicity, gender, school, and grade level. During the course of youth programming, information pertaining the Minor's academic achievement may be collected. This may include, and not be limited to, report cards, assignments, and ongoing progress reports. This information is used by Abode Communities to track the Minor's progress, help plan additional curriculum, and set goals for Minor participants. The Minor's personal information may also be used to protect the Minor's safety. All data collected will be compiled to report the number of website users, Program attendance levels, academic status and achievements, and to measure Abode Communities' social impact.
In addition to actively collecting the registration information described above, Abode Communities will use certain technical methods to passively collect information at gobeyondhomes.org. These methods include automatically embedded cookies and web beacons generated as part of the website creation process. Cookies are text files with small pieces of data that are used to identify your computer network. Web beacons are pieces of data that maintain record of your navigation through a single website or a series of websites. These website functions are automatically embedded through the creation of the website as a means to establish site analytics, maintain website performance, and detect and prevent site misuse. Neither cookies nor web beacons provide personally identifiable information. Abode Communities does not permit third parties to use cookies or web beacons to track its website users over time and across websites for the purpose of serving advertisements.
When does Abode Communities disclose information from Participants?
Abode Communities generally does not disclose the personal information of Program participants to third parties. Information from both adults and Minors, however, may be shared if reasonably necessary to protect the security and integrity of gobeyondhomes.org; to take precautions against liability; to respond to judicial process; or, to the extent permitted by law, to provide information to law enforcement agencies or for an investigation on a matter related to public safety. Abode Communities may also provide participants personal information to service provider partners who support the internal operations of its website. Service providers are instructed not to use or disclose participants' information for any purpose other than to provide specialized services that are not offered by Abode Communities.
Aggregate information, including information on the number of users and attendance levels, changes in academic performance, or other Program data, may be shared with programs funders to substantiate Program impact and solicit philanthropic program investment. In this case, limited identifying participant information will be shared without the participant's or Minor's express written approval.
How does Abode Communities involve parents/guardians in its collection and use of Minors' personal information?
Abode Communities requires that each minor's parent or legal guardian provide verifiable consent for each Minor to participate in virtual services at gobeyondhomes.org. In order to confirm the registration and for the Minor to gain access to gobeyondhomes.org, the parent or guardian must validate the registration and consent to the Minor's registration through a two-step authentication process. When the parent or guardian consents to the registration, the Minor's username will be enabled for website use. The parent/guardian may refuse to allow the Minor to register by not responding to the registration request over a period of 48 hours. A parent/guardian of a Minor may, at any time, contact Abode Communities to review the child's personal information, request the information or account be deleted, and/or request that no further information be collected.
Under both OPPA andCOPPA, participants always have the option of consenting to a website operator's use of Minor's personal information without providing your consent to its disclosure to third parties. Your consent is not required, however, for the disclosures and information sharing described above in the section of this Policy entitled "When does Abode Communities disclose information from Participants?" Therefore, this right is not applicable to those particular disclosures and information sharing.

Parental Consent
By checking the box below, I hereby affirm:
I grant permission for my child to participate in live, virtual resident services offered by Abode Communities. I understand that live virtual services are not prerecorded and that anything stated or exposed during the virtual learning services cannot be edited before the student witnesses the content. I also understand there are certain risks inherent by participating in social networking and other online platforms, and I am willing to assume those risks on behalf of my child.
I understand that virtual learning services includes Zoom, Skype, or other "virtual clubs" where my child's video feed and username will be seen by other participants. I also understand that virtual services include one-on-one homework help sessions with Abode Communities' staff for homework and other assistance.
I hereby grant to Abode Communities the right and permission to use my child's likeness, including photos, videos, and screenshots, in any manner and in any media, for the purpose of retransmission of learning sessions, as well as for advertising and publicizing Abode Communities. I further understand that neither I nor my child has any interest or ownership in the any such use or advertising (or any portion thereof) or its copyright.
I hereby consent to Abode Communities' collection, use, and/or disclosure of information about Minor participant(s) through its virtual youth program registration process and other manual and/or electronic procedures of Abode Communities or associated web-based providers.
I release, waive, and discharge Abode Communities and all of their principals, partners, officers, directors, managers, agents, employees, affiliates, parent and subsidiary organizations, funders, insurers and representatives (together, the "Released Parties") from any and all liability, now and in the future, for any and all incidents, whether based on tort, contract, or other theories of recovery, whether due to negligence, gross negligence, or intentional act, regarding access to the virtual resident services or any other activities associated with the Program that may occur during my child's use of and/or attendance at the Program. I understand the Released Parties are not responsible for, or monitoring, if there is an emergency or any other event in my home or wherever my child is accessing the online program. I also understand the Program is being offered online and, despite any and all possible precautions and safeguards Released Parties take, it is still possible the Program and any computer or electronic link thereto could be subject to external hack or other interference. I further release Released Parties from any liability therefore, including claims of injury to my child or damage to any equipment or personal property.
I understand and agree that Abode Communities may collect and distribute information about my child through their online program, as set forth above.
I further understand that Adobe Communities is a mandated reporter under the California Office of Child Abuse Prevention (OCAP) and is required to report to local agencies any suspected incidence of child abuse or neglect.
Abode Communities has taken steps to be in compliance with federal legislation for child protection, including The Family Educational Rights and Privacy Act (FERPA - www2.ed.gov/policy/gen/guid/fpco/ferpa/) and the Children's Online Privacy Protection Act (COPPA - www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/childrens-online-privacy-protection-rule).

By acknowledging these terms and conditions, you give consent to Abode Communities to collect, use, or disclose information regarding virtual Program participant information based upon the aforementioned Program and privacy information.
